1. About these Terms

These Terms and Conditions ("Terms") govern your access to and use of The Clear Point Collective (the "Service"), a members-only subscription platform operated by Clear Point Advisory ("we", "us", "our"). By subscribing to or using the Service, you agree to be bound by these Terms.

2. Membership & Eligibility

Membership is open to individuals aged 18 or over who own, operate, or work within a business. You agree to provide accurate, current, and complete information during registration and to keep your account details up to date. You are responsible for maintaining the confidentiality of your login credentials.

3. Subscription & Payment

The Service is provided on a paid subscription basis. Current pricing is displayed on our home page in Australian Dollars (AUD) and is inclusive of GST where applicable. Subscriptions renew automatically at the end of each billing period (monthly or yearly) unless cancelled before the renewal date. You authorise us, or our payment processor, to charge your nominated payment method for each billing cycle.

4. Cancellation & Refunds

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period and you will retain access until then. Except where required by Australian Consumer Law, fees already paid are non-refundable.

5. Use of the Service

Membership is personal to you. You must not share your account, redistribute, resell, or republish content from the Service without our prior written consent. You agree not to use the Service for any unlawful purpose or in a way that could damage, disable, or impair the Service.

6. Intellectual Property

All content within the Service — including frameworks, tools, written material, scorecards, and templates — is owned by or licensed to Clear Point Advisory and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to access and use the content for your own internal business purposes during the term of your membership.

7. No Professional Advice

The Service provides general information, tools, and frameworks only. It does not constitute legal, financial, accounting, taxation, or other professional advice. Members should obtain advice from a suitably qualified professional before acting on any information provided through the Service. See our full disclaimer on the home page.

8. Limitation of Liability

To the maximum extent permitted by law, Clear Point Advisory excludes all liability for any loss or damage (including indirect or consequential loss) arising from your use of, or reliance on, the Service. Nothing in these Terms excludes any non-excludable rights you have under the Australian Consumer Law.

9. Changes to the Service or Terms

We may update the Service, pricing, or these Terms from time to time. Material changes will be communicated by email or through the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of Queensland, Australia. You submit to the exclusive jurisdiction of the courts of that State.
